Legal Ego

Every 3 years I am required to complete 45 hours of continuing legal education in order to keep my law license active. Luckily for my agoraphobic self, these hours can be completed via webinars. Lorraine found a bundle on-line that we are trying to get through before the end of the year in order to meet our deadline.

A lot of these CLEs  are really going to be applicable  and useful to my small business practice.

Attorney-Client Privilege and the Suicidal Client
An Overview of H-1 Visas
Legal Issues Relating to the Purchase and Sale of Art

Oh well, I guess it won't hurt to broaden my horizons.

One of the first webinars I watched was called Legal Aspects of Blogging presented by Ronald Coleman, an attorney blogger and legal counsel for the Media Bloggers Association (whatever that is).

He spent the first 10 minutes or so explaining what a blog is and explaining how great his blog is and explaining how everyone else's blog pretty much sucks ass. Yuk-- Attitudes like that are the reason I despise most attorneys and refused to go to my 15 year  law school reunion last month. I explained to Lorraine that most of those people were all a bunch of arrogant twats back in law school and  I can't imagine what supreme douche bags they are after practicing law for 15 years. And don't even get me started on our local bar association meetings.

Back to the webinar: Here is what Mr. Coleman had to say about bloggers (these are direct quotes).

"The vast majority of blogs, blogging and bloggers are of no interest to anyone."

"Most blogs don't deserve to be read. Most people are not good writers and don't necessarily have something to say"

and then he went on to say that most blogs "stink" and most bloggers are "unremarkable" and the only reason that anyone reads a blog is because they have a blog and they are part of a "mutual admiration society." HA! Has he ever been to a bar association meeting???

Typical lawyer. I  think his point was that most blogs are not read by very many people. However, he could not resist the urge to inflate his own ego in making the point. He also mentioned (at least three times) that his blog is one of the ABA top 100 blogs. In fact he started the hour long session with that point and ended it with that point.

If I could do it all over, I would be a florist.

Xenu and Baby Snatchers are on my nerves today

I am in a crappy mood today. It is snowing again and my work is driving me crazy. Luckily, I found this blog-hop to participate in. It is a place where I can safely tell the world to suck it. Not you, of course. I am mainly talking about these three fools.

1. Kelly Preston is allegedly pregnant. Uh, look hag, you are 47 (no offense to non-Scientologist ladies in their late 40s who are not with child). You pretty much killed your last kid with all your Scientology nonsense. No more please. Unfit. I don't care if you can afford 10 nannies.Your son had severe autism, he was not overrun by body thetans. All the auditing in the world and prayers to Xenu could not help him. It not only hurt him, it probably killed him.  You do not need to be on the cover of People Magazine, you need to be in a psych ward!

2. Our brilliant District Attorney is charging two ladies with felony impersonation for switching numbers during a bike race. He is the genius behind the Kobe Bryant waste of time prosecution and he also once charged a guy with a felony for throwing a snowball at a acquaintance (among other ridiculous things). Term limits are a good thing.

From 9 News (Denver). I am not including their full names because the whole thing is BS.

One racer, Katie B. , allegedly entered her name in the 40 to 49 year old women's heat, but had 36-year-old Wendy L.race for her. L. then took second place for B.. . . It is not like the racers were trying to win prize money, cash prizes are not awarded in the Leadville 100. Everyone who finishes gets the same thing: a Leadville Trail 100 silver belt buckle. District Attorney XXX  XXXX (editors note: I am X-ing his name out since I am sure he googles himself every day and I practice law here. I don't want to be on his shit list) says he still had to file charges. "I'm not sure of their motives either, but they did assume another persons identity, and one person gained a benefit from that," XXXXX said. It means both women are now facing felony charges for criminal impersonation, but will likely get that knocked down to a lesser charge.

The coveted prize for first and last and everything between.

If they did something so awful why are you reducing the charges, Mr. XXXX?  If it is not a big deal, why are you even charging them at all?  I smell a big fat media whore.

Now that his term is coming to an end, he is going to run for state office of some sort. Quit sucking on the public tit and get yourself real job a-hole.

3. Haiti let Laura Silsby, a whacko, "religious" child snatcher/baby seller out of jail. If she was stealing white babies somewhere, she would be in the pokey for the rest of her life. She will probably write a book saying God was directing her, sell it to the Palin crowd and become a millionaire. I hope I run in to her someday so I can taser her ass.

.

There you have it people, my top three irritants of the moment.

Have a sane day,

The Art of War, Judge Judy and Why I need a Bologna Sandwich

If you follow me on Twitter, Whats that? You dont follow me? Um--get your butt  to the side of my blog and follow me pronto. Anyway, I tweeted that 27% of Americans think Judge Judy would make a good Supreme Court Justice. This hard-hitting bit of news I read on Fox News online.  Let me preface the Fox News part. (ugghh. Why is it that most of what I do and say in life needs to be "prefaced?") Anyway I was reading either Sun Tzu's "Art of War" or Perez Hilton (one of the two) and I saw something along the lines that you should know what your enemy  is up to. See, this is where I get confused because I could have been reading  about actual war strategy or it could have been something about Lindsay Lohan and Sam Ronson's twitter battles. Anway, my mom is always throwing out this ridiculous crap that I know could only have come from Fox News. Like when she told me that if the health care reform passed she could lose her citizenship to a Nicaraguan. Yes, she was born in the US and so was her great grandma x 15. You can read more about the problems my heritage caused me when I filled out the census here.  I usually need to know what the context of her (mis)infomation is or was so we can have some sort of meaningful conversation.  So that is a partial explanation of why I read Fox News. The other part is that it has a Weekly World News feel to it.  Terrifying if you don't have a functioning brain. You know how you stand in line at the grocery store reading WWN and laughing to yourself and asking:  I wonder what kind of idiot would believe this nonsense?

Back to Judge Judy.

She puts the "ass" in crass and I like it. Recently throned Sonia Sodapop-whatshername is Latina so I am sure that she is sassy, but I dont think she is really crass-y sassy like Ms. Judy. Can you just imagine the looks on the uptight ivy league lawyers who argue before the Court (it is ok I can make fun of Latina women and attorneys since I am both) when she yells out her catchphrase:

"BALOGNA!!!!"

Other great quotes by J.J.(these are way funnier if you imagine that they are said during Supreme Court oral arguments by the way):

"I you live to be 100, you will never be as smart as me."
"I am here because I am smart, not because I am young and gorgeous. Which I am."
"You spent $72 getting your hair done? You wasted your money."
"I'm the boss applesauce."
"Sir, don't pee on my leg and tell me it is raining."
"This is not Let's Make a Deal and I am not Monty Hall."
"What school of double-talk did you go to?"
"That's why they don't let people drink until they're 21 years old, because even 21-year-olds are morons. 20-year-olds and 19-year-olds are double-morons. They shouldn't even be allowed out of the house after nine o'clock at night."
"Do you know when a gift becomes a loan? When the relationship is over. Have you ever heard that, sir? Well, neither have I. I just made it up. I'm going to put it on coffee mugs."

Plaintiff: He signed me a promissory note...
Judge Judy: I don't care if he signed you the Declaration of Independence!

You get the point. Love me some Judge Judy. Oh and she is way more qualified to sit on the big old bench than Sarah Palin is to sit in the big old house.

By the way, this is not the first time that bologna has come up in my blog. Go here  if you want to read more about bologna and actual words from my mother. Great, now I am hungry.

Now go follow me on Twitter. I am the boss applesauce!

I am a Green Bean

Yes. It is true.

Allow me to explain.  We recently received our census paperwork in the mail.  Mr. Census  is very interested in my race.  So are a lot of other people.

You see, I have olive skin.  Well, it is more of a creamy cinnamon (so says me), but most people call it "olive." When you are not exactly white people often ask "what are you?"

Ummm? A liberal. Agnostic. Brilliant.Ha!

I know what they are asking.  Is it rude to ask? Maybe. I don't think I would ever ask someone such an awkward question, but that is just me.  Other people do it all the time.

I always just start with the obvious answer.  Why I am Irish.  Hello-- my last name is (was)Kelley.

But wait, I have further proof of my leprechaun heritage other than just my maiden name.  My ears are a little deformed weird at the top. I have heard that this is considered lucky in the Isle of Green.

But that is not what they want to know.  What they want to know is ---where did you get that pigmentation?

I am sort of not sure.

My mom's ancestors were conquistadors. For real. In the 16th century, they left various countries such as Spain, Portugal and Greece and sought to conquer the New World (modern day SouthwesternUS) via Mexico City.

What were they seeking? Gold, silver, the fountain of youth?  No,  they proudly and bravely sought the title of "hidalgo"  which would make them noblemen. How very Don Quixote of them (or "quixotic" as I learned in college). Well,  at least they were adventurous.

That was a long, long time ago.   When they made it to New Mexico, the Native Americans were there.  According to old census records, some of my mom's ancestors lived on  "Indian" reservations.  AHA!  I am Native American right??

Does that make me entitled to start my own casino?

Welcome to Lori's Hidalgo Casino

Um, apparently not. You see,  I am not pure enough for these snobby tribes.  I need to be at least 1/2 pure Native American to join up and start getting my casino cash.  I get punished because my ancestors were not too good to breed with their oppressors.  Not fair.

Which lead me to the census question that has me troubled:

Is person of Hispanic, Latino  or Spanish origin?

Possible answers are as follows:

No.
 Well that's not my answer.

Yes, Mexican American
My Irish dad does live in Cozumel, but that is not right either.

Yes, Puerto Rican
I am not from New York so I know that is not the right answer.

Yes, Cuban
Ahh Havana looks so pretty. But no.

Yes, another Hispanic, Latino or Spanish origin-- Print origin. For example, Argentinean, Colombian, Spaniard, etc. _____________________________________.

Can I write "New Mexican"  or is that not good enough. Should I go back to 1598 and list "Spaniard?"

I am so confused.

Oh wait here is a "Native American" option.

Sweet!  Wait. hold up. They want to know what tribe I belong to. Is there room to explain how they won't let me join?

I think I will print a copy of this post with a note that I am just me.  A little Irish and a little Hispanic.  Your garden variety Green Bean.

Take that Mr. Census!

I  decided that my little law firm needs a new logo. After 5 years,  I want a new look for my website, letterhead, cards, etc.  I started a contest on Hatchwise.com where pro graphic designers compete for your business.  There have been 15 entries so far, but the contest runs for 8 more days. I cant wait to pick a winner and get moving. If you have a small business and need a logo, website, etc, you can host your own contest at Hatchwise (formerly elogo contest).

Oh I seem to have forgotten my blog theme-- the law

This is me, not breaking the law, in Mexico.

So my blog is titled and conceptualized around giving my thoughts (as an attorney and a regular person) on the law around this mountain community.  I started my blog back in 2005 but have only posted a few times, so perhaps I am  not inspired.  Trust me, there are plenty of ridiculous, yet true, stories to keep you entertained. I could write daily on Colorado's medical marijuana laws and the inevitable fall out.   Anywhoo, here is a little diddy for you. I am not sure why this guy is fighting this because the charge is a misdemeanor ticket in Colorado.

GEORGETOWN — A Colorado man who says his religion explains his marijuana use is fighting a possession charge in court.

Trevor Douglas says he admitted having marijuana in the car in August of 2009 when he was pulled over for having an expired vehicle registration in Clear Creek County. Douglas says that he shouldn't be punished for having the pot, though, because he says marijuana is the main sacrament of his religion.

Douglas is a member of the Hilo, Hawaii-based THC Ministry. He says his religion mandates marijuana use and that the drug is similar to wine used in the Christian rite of communion.

Douglas planned to represent himself in a hearing Tuesday. He also faces a charge of having drug paraphernalia.

Just thought I would inform those who don't know: Colorado State Patrol now has the capacity to scan your plate and know instantly if your tags are expired. Good to know if you are otherwise breaking the law.

May is almost over and summer is still MIA

Well I thought I would try my hand at this again since I had so much fun with my kitchen blog. I want to learn how to do this right though-- and I hope to improve.

So a quick recap of events this last month. (It is almost June and it is downright cold around here). Anyway here is what has been happening: Matt and I built a firepit, we were visited by a bear,we attended one graduation and two graduation parties, we watched the Nuggets in the playoffs, we hosted two big parties, we rearranged the living room, we finished up the kitchen remodel, we (ok matt) tiled the bathroom, we watched the rest of the American Idol season 8, we switched from Dish to Comcast (dumb move), we have gone on countless hikes, we have poached various hot tubs (if you live in Summit you are familiar with that), and we have planted 6 trees. Of course we did other other stuff, but those are the highlights that stick out in my mind.

Things I want to do this summer: get my fishing license and catch a bunch a fish, ride the tandem down Vail Pass, climb a 14er (Whaaat?), collect more moss for my pond, go camping, go to the Royal Gorge and Mesa Verde (i say that every year but have not been to either in like 25 plus years), go to Dallas and McAlester (that is for sure), go to Cozumel (that is I hope), play some golf, paint my bedroom, find a cool mirror for my bathroom, find a better shoe organization system, host a summer party to thank those who helped with the kitchen (and for anyone else that wants to come), get a cute shorter haircut and generally not stress out. Ohhhh and watch the Nuggets go all the way!!!
My daily thought on the law: What is up with the returning security at the Dam Road? Where did all the guards go in the Winter? I thought we were in danger of an imminent terrorist attack? Guess the terrorist like to go some place warm during the long winter. Here is a little excerpt from thethe Summit Daily News: The automated protective barriers sitting dormant on Dillon Dam Road since December could become active again in the next couple of weeks, said Denver Water spokeswoman Stacy Chesney. Law-enforcement officers stopped guarding either end of Dillon Dam last fall, and Denver Water security has been the primary daytime defense against a potential attack on the 231-foot-high earthen structure holding Dillon Reservoir’s 83 billion gallons of water. WTF??????

Here is a little excerpt from thethe Summit Daily News: The automated protective barriers sitting dormant on Dillon Dam Road since December could become active again in the next couple of weeks, said Denver Water spokeswoman Stacy Chesney. Law-enforcement officers stopped guarding either end of Dillon Dam last fall, and Denver Water security has been the primary daytime defense against a potential attack on the 231-foot-high earthen structure holding Dillon Reservoir’s 83 billion gallons of water. WTF??????

Yet Another Dumb Ass in Vail

A couple of months ago a guy in Vail hired some guys to kidnap him. The plot included tying up his wife and possibly some kind of sexual assault against her. Later that night husband and pretend kidnappers went to a party. Not so smart. This past Saturday some guy (assuming different from kidnapee discussed above) was arrested in Vail for trying to coerce his girlfriend (who is a witch) to poison his estranged wife. Witch told authorities that boyfriend said he would understand if the witch wanted to off herself after the hit. . . and people think that Vail is so much more glamorous than Summit County.
